Yes, we're finally cracking down on it. In case you didn't know, if you lied about your age (clicking the 13 and over link) and you were really under 13, you were breaking the law. Since the administrators are technically breaking the law as well by allowing you to be a member knowing you were underage, we're going to start banning people, going by this list:

Quote:
1995-2007: Twenty members.
Pokemaniac - February 10, 1995 (12)
comcast - March 16, 1995 (12)
Shiny Latios - May 25, 1995 (12)
locdog [erik] - June 1, 1995 (12)

Gnaaye - July 13, 1995 (12)
Neo Matrix - May 2, 1995 (12)
bre1oom - September, 16 1995 (12)
Cerebus - October 11, 1995 (12)
Xaliaphous - December 2, 1995 (12)
SulfoniX - January 1, 1996 (11)
pokemc33 - February 10, 1996 (11)
Lintaro - March 28, 1996 (11)
Blazikendude - May 5, 1996 (11)
Treeckoluv - May 5, 1996 (11)
ScizorManiac - July 10, 1996 (11)
Lone--Wanderer - August 2, 1996 (11)
meganiumaster - August 30th 1996 (11)
Treeckomaster - September 19, 1996 (11)
Ghett0 - August 12, 1998 (9)
Medichamrulz

I'll be sending a PM to each individual member warning them about it, and if they'd like, they can submit their email to me, I'll send them the COPPA form (via email), and they can have their parents sign it. Refusing to comply will result in a ban.

'96 seems so young, my brain's stuck in '98.

If kids lied about their age on the registration form how would you find out?

And when we find out, we're calling the cops to have your parents hauled off to jail. Remember, we have your IP address. :)

It would be illegial for them to join without COPPA if this site collected their information commercially. Because its a privately owned website (by you wonderful admins) technically speaking its perfectly legal for anybody to come and register unless you put it in the registration terms.

If its little kids you're worried about coming to the site, simply put an age restriction in the terms of use. If they don't abide, technically that's breaking the rules of this site, if they persist they are likely violating their ISP's terms of use.

COPPA is only good for sites like eHarmony, which I'm glad to finally be a part of. Nothing like a good internet date in a chat room.

COPPA Website wrote:
Who Must Comply

If you operate a commercial Web site or an online service directed to children under 13 that collects personal information from children or if you operate a general audience Web site and have actual knowledge that you are collecting personal information from children, you must comply with the Children's Online Privacy Protection Act.

*

To determine whether a Web site is directed to children, the FTC considers several factors, including the subject matter; visual or audio content; the age of models on the site; language; whether advertising on the Web site is directed to children; information regarding the age of the actual or intended audience; and whether a site uses animated characters or other child-oriented features.
*

To determine whether an entity is an "operator" with respect to information collected at a site, the FTC will consider who owns and controls the information; who pays for the collection and maintenance of the information; what the pre-existing contractual relationships are in connection with the information; and what role the Web site plays in collecting or maintaining the information.

Personal Information

The Children's Online Privacy Protection Act and Rule apply to individually identifiable information about a child that is collected online, such as full name, home address, email address, telephone number or any other information that would allow someone to identify or contact the child. The Act and Rule also cover other types of information -- for example, hobbies, interests and information collected through cookies or other types of tracking mechanisms -- when they are tied to individually identifiable information.

You could argue Pokemon is a general audience phenomenon, thus this website is directed towards a general audience and not children.

...thanks for the info? I think it's best if we keep our forums (generally) 13+, as it filters out good discussion with...childish mayhem.

Hmm, half these COPPA forms I'm looking at indicate gender, home town, and other such PERSONAL INFORMATION. Just because it's not REQUIRED that said information be entered doesn't mean it's not worth the extra effort to err on the side of caution and require the COPPA anyway, since children can opt to enter information that falls under the COPPA act.
